The Role of the Notary in a Spanish Will

In Spain, all valid wills must be signed before a Spanish notary; a public official responsible for formally witnessing the will and ensuring it is properly registered.


Here’s what the notary does:

  • Confirms your identity and legal capacity to make a will.

  • Witnesses the signing of the will in their official register.

  • Files the will with the Spanish Central Registry of Wills, so it can be located after your death.


You will require a translator for most Notary appointments if you do not speak Spanish. If you need this service we can help to arrange it for you.
